Terms and conditions

These terms and conditions will be part of the contract between the customer and The Witching Hour.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using

any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms

and conditions of this agreement, then you may not access the website or use any services.

All the orders placed the online store are subjected to the present terms and conditions and any order placed

by the customer implies the acceptance of the present terms and conditions.

The Shop reserves the right to adapt or to modify at any time the present terms and conditions.

Modalities, descriptions and prices:

Items on sale on the online store are presented and detailed so that every customer is capable of knowing the essential

characteristics of the items he would like to buy.

The photos illustrating the description of items are given as a rough guide and are not contractual. As the gemstones can

be natural and items are handmade, it can exist slightly differences of color and details between the items shown on the

pictures and the items that the buyer will receive.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the

store. But we cannot guarantee that your computer monitor's display of any color will be accurate.

The prices are in euros and exclude the shipping costs. If you use the converter of foreign currencies available on the online

store, the prices can be slightly different on the shop and at the time of the payment, this is because of the constant

change of the rate of conversion of the various currencies. The prices shown thanks to the automatic converter of the shop

are given only for informational purposes, and The Witching Hour cannot be considered responsible for these differences

between the prices.

The shop reserves the right to revise its prices at any time but makes a commitment to apply the current prices at the time

of the order, subject to the availability at this date.

The method of dispatch and the shipping costs are according of the weight of the package and of the zone of destination of

the order.

The prices shown are therefore exclusive of tax, but you will not be charged any tax during the ordering process, unless you

live in the UK as since Brexit we are obliged to collect a tax which is then passed on to the UK government.

Shipping:

The delivery method and the shipping costs are according to the weight of the package and the destination of the order and

are calculated according to the rates of the french postal service.

Different mode of delivery can be proposed to the customers, according to the country of destination and to the weight of

the items.

The goods appearing on the web site are in stock and the orders are treated within the next 72h, from Monday to Friday

included. The dispatch is usually made in the next 48h after the reception of the payment of the order.

The customer has to check carefully the informations they give to the online store. In case of return of the

package because of a mistake in the address given by the customer, of a missing name on the mailbox or not retreat

of the parcel at the post office, the shipping costs to ship again the package will be chargeable to the customer.

The postal service may also take longer than usual, especially during sales, and holidays or during the summer.

We therefore invite you to take this into account when placing orders during these periods of the year.

These possible delays are totally beyond our control, therefore The Witching Hour cannot be held responsible for them.

 

If your package is not delivered:

In case of non-receipt of the package, the tracking number will attest of the delivery or non-delivery of the package.

The customer must contact the store as soon as possible to report the non-receipt of the parcel, and after examining the

situation, the shop may file a claim with the postal service.

Please note that we take this type of situation very seriously and make it a point of honour to resolve them.

If the post office confirms that your parcel is lost, we will resend your order to you.

However, as the tracking number is proof that the parcel was sent, the shop cannot be held responsible for the possible

non-receipt of the parcel and / or its loss by the postal service.

Consequently, no refund or exchange can be claimed without a complaint to the Post Office (made by us), and a response

from the Post Office certifying that the package is lost.

If the tracking number of the parcel indicates that it has been delivered, no claim can be made to the postal service, and no

exchange or refund can be made.

If you frequently encounter difficulties in having your order delivered by the postal service, we invite you to choose the

delivery method "Colissimo with delivery with signature" in order to avoid any problem.

It is also the customer's responsibility to ensure that their name is on their letterbox so that the postman can deliver the package.

Custom charges, taxes for international customers:

During international shipping, customs charges or taxes can be asked to the customer in case of control of the package.

This fact is totally out of The Witching Hour control, so their amount cannot be asked to the store.

Only the buyer will have to pay every taxes and custom charges asked by the postal service.

Return of the items:

According to the law, the buyer has a time allowed of 14 days from the reception of the order to return the item bought.

The right of return can be applied only if the procedure below is respected and only if the items returned during the time

allowed of 14 days still be sealed and in perfect condition.

Above all return, the customer has to contact the customer service of The Witching Hour by email, via the contact form of the online store.

The returned package must be shipped with a tracking number.

In case of loss of the package by the postal service, The Witching Hour will ask you the number to track the package.

The shipping costs of the package to return the items are chargeable to the sender.

No package sent in mode with repayment will be accepted by The Witching Hour.

If the procedure above is respected, The Witching Hour makes a commitment to make an exchange or a refund of

the items for a maximum time allowed of 14 days following the reception of the returned goods.

Payment:

The items ordered are payable counting and without any discount, the means of payment is in the choice of the buyer

among those proposed by The Witching Hour and depending of the country of the buyer:

-Credit card payment: payments are made via the solution of secure on-line payment Payplug.

The Witching Hour will never have any access to your payment informations.

-Bank transfer: The customer has a time allowed of 7 days to make the bank transfer, after these 7 days the order will be cancelled.

If you have not received the email containing the payment information, please check the spam folder in your emailbox.

- Amazon Pay: Pay with your Amazon account. We haven't any access to your payment informations.

The Witching Hour has no access to the bank informations.

As a result of which these informations are not kept on the servers and are asked at every new transaction on the website.

Processing of personal data, privacy policy:

During the process of your order, the shop will collect your name, first name, address and email address, to be able to handle and to ship your order.

Your name, first name and address (and maybe your phone number if you want to give it) are then transmitted to

The Post office as far as they appear on your package and this in the purpose that you can receive the items that you bought.

These informations collected by The Witching Hour will never be transmitted to any third-party, except The Posal service, as explained above.

Your informations are saved on the website server and are accessible only by you, by connecting to your customer account,

and by The Witching Hour. You can rectify at any time these informations or ask for the deletion of your customer account

(what will engender the deletion of these informations on our server).


The shop has no access to your payment informations. Credit card informations are always encrypted during transfer over networks.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the french laws.

Any contesting relative to the interpretation or to the execution of the orders will be examined with the biggest care and will be the object of an immediate amicable proposal.

In case of contesting not resolved between the shop and the buyer, only the commercial court the closest to the shop will be competent on the subject.
